1. Agreement to Terms

By accessing or using this website or purchasing products from Wyxelware ("Company," "we," "us," or "our"), you accept and agree to be bound by and comply with these Terms of Service. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Wyxelware's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

Wyxelware assumes no responsibility for injury, damage, or liability resulting from improper use, misuse, or use of the gage or any part of it by any individual.

Technical Limitations

The Wyxelware manifold gauge is a diagnostic tool and provides measurements based on sensor inputs. While designed for accuracy, all instruments have measurement tolerances and limitations. Users are responsible for:

  • Understanding normal measurement tolerances and accuracy specifications

  • Verifying readings through independent methods when safety-critical decisions are involved

FURTHER, WYXELWARE DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS CONCERNING THE ACCURACY, LIKELY RESULTS, OR RELIABILITY OF THE USE OF THE MATERIALS ON THIS WEBSITE OR OTHERWISE RELATING TO SUCH MATERIALS OR ON ANY SITES LINKED TO THIS SITE.

5. Limitations of Liability

IN NO EVENT SHALL WYXELWARE OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR PROFIT, OR DUE TO BUSINESS INTERRUPTION) ARISING OUT OF THE USE OR INABILITY TO USE THE MATERIALS ON WYXELWARE'S WEBSITE, EVEN IF WYXELWARE OR A REPRESENTATIVE HAS BEEN NOTIFIED ORALLY OR IN WRITING OF THE POSSIBILITY OF SUCH DAMAGE.

WYXELWARE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE USE, MISUSE, OR INABILITY TO USE THE PRODUCT, INCLUDING BUT NOT LIMITED TO:

  • Personal injury or property damage

  • System failures or refrigerant release

  • Environmental damage or contamination

  • Regulatory violations or fines

  • Loss of business or income

  • Incorrect diagnostic results or decisions made based on product readings

  • Third-party claims or liabilities

6. Product Warranty

Wyxelware warrants that products will be free from defects in materials and workmanship under normal use for a period of twelve (12) months from the date of purchase. This warranty does not cover:

  • Damage from misuse, abuse, or accident

  • Damage from improper storage, maintenance, or calibration

  • Damage from unauthorized repair or modification

  • Normal wear and tear

  • Damage from external electrical events

  • Cosmetic damage that does not affect functionality

The sole remedy for breach of this warranty is repair or replacement at Wyxelware's sole discretion. This warranty is exclusive and in lieu of all other warranties, express or implied.

7. Assumption of Risk

By purchasing and using Wyxelware products, you acknowledge and assume all risks associated with:

  • The use of HVAC diagnostic and refrigerant handling equipment

  • Potential exposure to pressurized refrigerant systems

  • Electrical hazards associated with the product

  • Results or decisions made based on product measurements

  • Compliance with all applicable regulations and standards

  • Any injury, damage, or liability arising from product use

8. Indemnification

You agree to indemnify, defend, and hold harmless Wyxelware, its owners, employees, agents, and suppliers from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the product

  • Your violation of these Terms of Service

  • Your violation of any applicable law or regulation

  • Injury or damage caused by your use of the product

  • Your negligence or intentional misconduct

  • Third-party claims arising from your actions

9. Regulatory Compliance

Users are solely responsible for compliance with all applicable federal, state, and local laws and regulations, including but not limited to:

  • EPA regulations regarding refrigerant handling and certification

  • ASHRAE standards for HVAC system servicing

  • AHRI standards for equipment and components

  • State and local licensing requirements for HVAC technicians

  • Proper refrigerant recovery and disposal requirements

  • Environmental Protection Agency (EPA) Clean Air Act requirements

Wyxelware makes no warranty that its products will ensure regulatory compliance. Compliance responsibility rests solely with the user.

10. Professional Liability

This product is intended for professional use by trained HVAC technicians and contractors. Users understand that:

  • They maintain full liability for any damage, injury, or loss resulting from their use of the product

  • They are solely responsible for maintaining proper insurance coverage

  • They should consult with legal and insurance professionals regarding liability exposure

  • Professional licensing and certification requirements vary by jurisdiction

11. Modifications to Terms

Wyxelware may revise these Terms of Service at any time without notice. By using this website and purchasing products, you are agreeing to be bound by the then current version of these Terms of Service.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. You irrevocably submit to the exclusive jurisdiction of the courts located in Arizona.

13. Severability

If any provision of these Terms of Service is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be reformed to the minimum extent necessary to make it valid and enforceable.
